3DICOM Viewer and associated tools are products/services developed and delivered by Singular Health Pty Ltd, part of the Singular Health Group which includes Singular Health Pty Ltd and Singular Health Group Limited (collectively, “Singular Health” or “we”). This privacy policy describes our personal data handling practices.

I. When this Privacy Policy applies

The Privacy Policy applies to personal data collected from or about (i) users of the 3DICOM software suite (including 3DICOM for Patients, 3DICOM for Practitioners, 3DICOM for Education and the 3DICOM Mobile App for iOS and Android) and related services (collectively, the “3DICOM Suite”), (ii) visitors to our website https://learn.3dicomviewer.com (“Website”), (iii) our suppliers, vendors, and other business partners (collectively “Business Partners”), (iv) our customers’ business contacts, and (v) to other individuals who contact us (online and offline). This Privacy Policy applies to any website or service that posts a link to it.

This Privacy Policy does not apply to personal data about current or former employees, independent contractors or job applicants.

II. Personal Data Collection

The 3DICOM Suite collect the following personal data from individuals, including users of the 3DICOM Suite and visitors to our websites:

  • Personal contact information, such as your name, email address and phone number.
  • General usage Meta-Data, such as log-in time and details, errors, searches and session usage on the 3DICOM Suite.
  • Scan usage Meta-Data, such as the Number of scans loaded , sharing, tools used, and time spent per scan. Such data is only collected about registered users who choose to upload their medical image(s), in the form of a DICOM file, to the 3DICOM Suite.
  • Medical scans that may reveal medical data (which may constitute “special categories of data” or “sensitive information” in your country) as well as DICOM tags. Such data is only collected about registered users who choose to upload or otherwise share their medical image(s), in the form of a DICOM file, to the 3DICOM Suite .
  • Other information that you provide to us, such as information submitted through our website’s “contact us” function or technical support requests
  • If you use Google Single Sign On (SSO) to access the 3DICOM Suite, your provide us or allow access to your Name and Public Profile, Email, and Profile Picture displayed on your Google Account.
  • The 3DICOM Suite also collects the following personal data from practitioners, researchers and enterprise clients or distribution partners:
  • Personal contact information, such as your name, title, email address or phone number or any such information which relates to medical practitioners, researchers or software users within your organisation
  • Input that you provide on patients’ medical images, including measurements, mark-up, annotations and opinions
  • Information about your or your users’ use of the software, including tools used and time spent reviewing each scan.
  • Other information that you provide to us, such as information submitted through technical support requests

The 3DICOM Suite also collects the following personal data from practitioners, researchers and enterprise clients or distribution partners:

  • Personal contact information, such as your name, title, email address or phone number or any such information which relates to medical practitioners, researchers or software users within your organisation
  • Input that you provide on patients’ medical images, including measurements, mark-up, annotations and opinions
  • Information about your or your users’ use of the software, including tools used and time spent reviewing each scan.
  • Other information that you provide to us, such as information submitted through technical support requests

Collecting some of the information listed above, including your contact information and medical scans, is necessary for us to enter into a contract with you, such as our Terms of Use. If you do not provide it to us, we may not be able to process your order or otherwise provide you or your organisation with the product or service you have selected.

Means of collecting Personal Data

You directly provide the 3DICOM Suite with most of the data we collect. We collect data and process data when you:

  • Register online or place an order for any of our products or services;
  • Voluntarily complete a customer survey or provide feedback on any of our message boards, via email or otherwise through our website;
  • Use or view our website via your browser’s cookies; or,
  • Use our 3DICOM Suite, whether as a patient, practitioner or researcher.
  • Purchase or distribute our 3DICOM Suite as a client or distribution partner.

The 3DICOM Suite may also receive your data indirectly from the following sources:

  • If you are a patient, from a medical practitioner or other healthcare provider who treats you or has reviewed your medical image(s).
  • For some patients, from someone who is responsible for you, like a parent, guardian or carer.
  • Google Analytics, Google Ads, and Facebook or other advertisers.
  • SSO / OAuth.

III. Personal Data Use

We collect your data through the 3DICOM Suite so that we can:

  • Process your order.
  • Create, maintain and continue to serve your account.
  • Personalise your experience, for example by reference to your name and public profile.
  • Facilitate collaborative features, collaborative sessions, scan sharing or other features offered within the product.
  • Communicate with you about your account, transactions or other updates, including by sharing notices with you that we are required to disclose under law or contacting you with further details or instructions for using the 3DICOM Suite.
  • Ensure that medical practitioners and researchers are able to perform their functions or any activity requested of them.
  • Email you with special offers on other products and services we think you might like.
  • Promoting the 3DICOM Suite, including presenting and measuring the effectiveness of our advertisements, offers, surveys and events.
  • Secure the 3DICOM Suite, including by detecting fraud and otherwise protecting the 3DICOM Suite from illegal or harmful actions.
  • Complying with our legal and contractual obligations, including enforcing our Terms of Use, responding to requests from law enforcement authorities or moderating illegal content or conduct on the 3DICOM Suite.
  • Perform internal functions, such as record keeping, administrative purposes, invoicing and billing.
  • Understand how the 3DICOM Suite is used. We also improve our software products/services using aggregated and anonymized meta-data which has been generated from your personal data.

IV. Personal Data Disclosures

We may share some of the information we collect for the purposes set out above. This may include to the following persons:

  • Medical practitioners and researchers to whom you have authorised us to share your personal data.
  • Other users of the 3DICOM Suite to whom you have authorised us to share your personal data via sharing/sending functionality on the platform.
  • Suppliers who support us to conduct our business, including cloud, cybersecurity, payment and other service providers who help us to operate the 3DICOM Suite and our websites.
  • Other entities on a “need to know” basis. For example, we may need to consult legal or accountant service providers.
  • Other members of the Singular Health Group.
  • Courts, enforcement bodies, regulators and other official authorities where required or authorised by law.
  • (in the context of representatives from enterprise clients and distribution partners) Your employer or the organisation who has engaged you, in order to facilitate and continue our business relationship.

Some of these persons may be located outside of Australia, including in countries like the United States of America, the United Kingdom and Singapore.

V. Personal Data Storage

We store your data through the 3DICOM Suite at https://learn.3dicomviewer.com which is HTTPS encrypted and maintained on a secure AWS server, and our internal server.

We will keep your personal and cookie data for up to 3 years unless another law applies. Once this time period has expired, we will take reasonable steps to delete your personal data.

VI. Marketing

We would like to send you information about products and services of ours that we think you might like, as well as those of our partner companies.

These emails are necessary for the proper functioning of our services and are not promotional in nature.

Please know that your privacy rights are not absolute and do not apply in every circumstance. We may limit or reject certain requests when the applicable law requires or allows us to do so, such as when a request is unlawful, duplicative or may infringe on privacy rights of a third party or if we are not able to verify your identity.

We often need to retain certain data for recordkeeping purposes and/or to complete any transaction that you began prior to requesting a change or deletion. Our databases and other records may have residual data which will not be removed.

X. Changes to our privacy policy

We may amend this Privacy Policy to reflect new features of the 3DICOM Suite and other business changes and for compliance with applicable laws. When we update this Privacy Policy, we will post the updated version and change the “Last Updated” date above. We also will take appropriate measures to provide notice to you in advance of changes that we believe reduce or materially change your privacy rights so that you have an opportunity to review the revised Privacy Policy before it applies to your personal data. If your consent is required by applicable data protection laws, we also will obtain your consent to changes before the revised Privacy Policy applies to your personal data. Otherwise, your continued use of the 3DICOM Suite after the “Last Updated” date and if applicable to current users, the end of the notice period. constitutes acceptance of the amended Privacy Policy. As of the “Last Updated” date, the amended Privacy Policy supersedes all previous versions.

The Right to Access – You have the right to request copies of your personal data. We may charge you a small fee for this service.

The Right to Rectification – You have the right to request that we correct any information about you which is inaccurate, out-of-date, irrelevant or misleading. You also have the right to request us to complete the information about you which is incomplete.

How to complain about our handling of personal data

Should you wish to report a complaint or if you feel that we have not addressed your concern in a satisfactory manner, please endeavour to contact us in the first instance. We will respond to your concern within a reasonable time.

If we have valid reasons not to honor your request relating to your personal data, we will provide you with a written explanation as requires by law.

The legal bases we rely on to process your personal data depend on who you are and how your interact with the 3DICOM Suite. They primarily include:

  • Contractual necessity: We process your personal data where necessary to perform and enforce our contracts with you. This may include processing your order; creating, maintaining and continuing to service your account; facilitating features in the 3DICOM Suite which you have requested to use (e.g. scan sharing); communicating with you about your account, transactions or other updates; ensuring that medical practitioners and researchers are able to perform their functions; securing the 3DICOM Suite and enforcing our Terms of Use and other legal agreements with you.
  • Legitimate interests: We process personal data where it is necessary for our legitimate interests, except where such interests are overridden by your interests or fundamental rights. This may include personalising your experience in the 3DICOM Suite; contacting you on special offers on other products and services we think you might like; promoting the 3DICOM Suite; performing internal functions and understanding how the 3DICOM Suite is used.
  • Legal obligations: We process personal data where it is necessary for compliance with a legal obligation to which we are subject. This may include enforcing our Terms of Use, responding to requests from law enforcement authorities, or moderating illegal content or conduct on 3DICOM Suite.
  • Consent: We process personal data when you provide us with your consent to do so. You may withdraw your consent at any time using the details at How to contact us above. Withdrawal of your consent will not affect processing of your personal data which took place with your consent before you withdrew your consent.

Transfers of your personal data

We may transfer your personal data outside of the European Economic Area, including to Australia and the United States of America. When we do so, we ensure that appropriate safeguards are in place, which generally include entering EU Standard Contractual Clauses (with supplements in accordance with Switzerland’s Federal Act on Data Protection and the UK’s Data Protection Act 2018) with the recipient of the personal data.  

Automated decision making

We do not use automated means (including profile) to make decisions about you that have legal or similarly significant effects.

Your personal data rights

You are granted certain fundamental rights when personal data about you is processed. These rights (known as data subject rights) are:

  • Request confirmation of whether we process personal data relating to you, and if so, to access that personal data and certain information about that personal data;
  • Request that we rectify or update your personal data that is inaccurate, incomplete, or outdated;      
  • Request that we erase your personal data in certain circumstances provided by law;
  • Request that we restrict the processing of your personal data in certain circumstances, such as while we consider another request that you have submitted (including a request that we make an update to your personal data);

  • Where the processing of your Personal Data is based on your previously given consent, you have the right to withdraw your consent at any time;
  • Right to object to our processing of your Personal Data in certain circumstances provided by law.

We will ensure that we reach out without undue delay (no more than one month) after you submit a request related to exercising your data subject rights. Although uncommon, when applicable for official or legal reasons, we may be unable to address the specific request you make regarding your rights, or we may delay our response where required.

Additionally, if a request is clearly unreasonable or overly burdensome, we may either:

  • impose a reasonable fee that reflects the administrative costs of fulfilling the request; or
  • decline to process the request.

In this scenario, will we inform you of the reasons we believe your request is the manifestly unfounded or excessive character of the request.

If you believe that you have not received a satisfactory response from us, you may have the right under applicable laws to consult with the national data protection authority in your country. You can find a list of applicable data protection authorities here.

To ensure your protection, we may confirm your identity prior to addressing your request. This could involve verifying that the email address from which you submit the request aligns with the one we have on record. Additionally, we may require further information for identity verification, such as a government-issued ID.
